Terms & Conditions.
(Effective November 2025)
These Terms & Conditions (“Terms”) outline the agreement between you (“the Client”) and Nicole Marion (“we”, “us”, “our”) regarding the provision of counselling, energy healing, embodiment, and mentoring services.
By booking, purchasing, or participating in any of our offerings, you acknowledge and agree to these Terms.
1. Services Provided
1.1 We blend counselling, energy healing, trauma-informed embodiment work, and mentoring (the “Services”) to support personal transformation, emotional regulation, and spiritual growth through the integration of the many dimensions of self, physical, mental, emotional, energetic, and spiritual.
1.2 Our offers may include one-to-one consultations, group programs, workshops, retreats, online modules, workbooks, and other experiential or educational resources designed to nurture wholeness, awareness, and self-mastery.
1.3 Prior to commencing any Service, you will receive a consent form, and privacy information outlining the nature of the work, the approach taken, and your rights and responsibilities. This process aligns with the Australian Counselling Association (ACA) Code of Ethics and Practice and recognised standards for consent, intake, and confidentiality in Australian private practice.
1.4 While the Services are designed to facilitate growth, healing, and integration, we do not guarantee specific outcomes. The process is participatory and results depend on your level of commitment, self-reflection, and consistent engagement over time.
These Services are complementary in nature and are not a substitute for medical, psychological, or psychiatric care. If you have any health or mental-health concerns, please seek advice from a qualified medical or allied-health professional.

2. Engagement & Agreement
2.1 By booking or purchasing any Service, you enter into a binding agreement with us under these Terms.
2.2 We will outline all fees, inclusions, session durations, and delivery methods (in-person or online) prior to commencement.
2.3 You confirm that you are over 18 years of age and have the capacity to consent to the Services.
2.4 You agree to participate with respect, honesty, and openness, acknowledging that personal transformation is a collaborative process.
3. Fees & Payments
3.1 Fees are displayed at the time of booking or as confirmed in writing via email or invoice.
3.2 Payment must be made in full prior to the session, program, or event unless an alternative arrangement is confirmed in writing.
3.3 Access to digital resources, workbooks, or online modules will only be provided once payment is received.
3.4 We reserve the right to adjust fees at any time. Price changes do not affect sessions or programs already booked and paid for.
4. Cancellation & Rescheduling
4.1 You may cancel or reschedule a booked session by providing at least 24 hours’ notice.
4.2 If notice is given within this timeframe, your session may be transferred to another available date without penalty.
4.3 Cancellations made with less than 24 hours’ notice, or failure to attend, will result in the full session fee being forfeited.
4.4 If we cancel due to illness or unforeseen circumstances, the session or ticket will be transferred to another suitable date, course, or offer.
4.5 No refunds are provided for cancellations, non-attendance, or change of mind. Tickets or purchases may, however, be transferred to another course, session, or offer within twelve (12) months of the original booking date, subject to availability.
These terms do not override your rights under the Australian Consumer Law (ACL) to a remedy where services are not provided with due care and skill or are misrepresented.
5. No Refunds & Transfers
5.1 Once a workbook, resource, recorded material, or program access has been provided to you, refunds are not available.
5.2 If you have not yet received any workbook, resource, recording, or program access, and you notify us at least three (3) days before the scheduled session or program start, we may allow you to transfer your payment to a future equivalent session or program (subject to availability). Such transfers must be used within twelve (12) months of the original booking date.
5.3 We reserve the right to refuse a transfer if you have already accessed, downloaded, or used the provided materials or services.
5.4 These refund and transfer terms are in addition to, and do not override, your rights under the Australian Consumer Law (ACL) with respect to services that are not delivered with reasonable care and skill or are not fit for purpose.
6. Confidentiality & Privacy
6.1 All information shared in sessions or related correspondence will be treated as strictly confidential and stored in accordance with the Privacy Act 1988 (Cth) and professional ethical standards.
6.2 Confidentiality may be broken only where required by law, for example, if there is risk of harm to yourself or others, or in cases of child-protection concerns.
6.3 You have the right to access and request correction of your records, unless restricted by law.
6.4 We will never share your information with third parties without your consent.
7. Professional Boundaries & Ethical Standards
7.1 We uphold the Australian Counselling Association (ACA) Code of Ethics and Practice, including principles of respect, integrity, competence, and confidentiality.
7.2 Our Services are not medical in nature and are intended as complementary support. We do not diagnose or prescribe medication.
7.3 You agree to maintain mutual respect and appropriate boundaries throughout our professional relationship.
7.4 We reserve the right to terminate services if boundaries are breached, safety is compromised, or the work is no longer deemed appropriate.
8. Intellectual Property
8.1 All workbooks, materials, recordings, and resources provided remain our intellectual property.
8.2 These materials are for personal use only and may not be copied, shared, distributed, or reproduced without written permission.
9. Limitation of Liability
9.1 To the extent permitted by law, we exclude liability for indirect or consequential loss arising from your participation in our Services.
9.2 Nothing in these Terms limits your statutory rights under the Australian Consumer Law.
9.3 These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
10. Termination of Engagement
10.1 We may terminate or suspend Services if:
- Payment has not been made;
- You engage in harmful, abusive, or inappropriate behaviour; or
- It is professionally determined that continuation is not in your best interest.
 10.2 You may cease Services at any time; however, no refunds are provided for sessions or programs already delivered.
11. Communication & Online Delivery
11.1 Online sessions are conducted using secure platforms. You are responsible for ensuring privacy and stability of your internet connection.
11.2 We will communicate via email, phone, or messaging regarding session details and materials. Please ensure your contact details are current.
11.3 We are not liable for interruptions, delays, or technology failures beyond our control.
12. Feedback, Complaints & Dispute Resolution
12.1 We welcome feedback to continually improve our Services.
12.2 If you have a concern or complaint, please raise it directly so we can address it promptly and respectfully.
13. Amendments
13.1 These Terms & Conditions may be updated from time to time. The latest version will always be available on our website or by request.
13.2 The Terms in place at the time of booking will apply to that Service.
14. Acceptance of Terms
By booking or purchasing any Service, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
